The Indian Railways is set to implement revised penalty provisions under the Jan Vishwas (Amendment of Provisions) Act, 2026, which introduces changes to certain sections of the Railways Act, 1989. The updated rules are expected to come into effect from July 1 through a separate notification by the Central Government.
Key amendments have been made to Sections 137 and 138 of the Railways Act, primarily addressing ticketless travel and travel beyond the permitted distance. Under the revised provisions, the minimum penalty has been increased from ₹250 to ₹500, aiming to curb ticketless travel, strengthen compliance, and protect railway revenue.
As per Section 137, passengers traveling without a valid ticket or pass will now be subject to a minimum penalty of ₹500. However, there is no change in the maximum punishment, which remains up to six months of imprisonment, or a fine up to ₹1,000 imposed by a court, or both.

Similarly, under Section 138, the minimum excess charge for passengers traveling without a proper ticket or beyond the authorized distance has been raised from ₹250 to ₹500.
The amendments also clarify the distinction between a “penalty” and a “fine.” While authorized railway officials can impose penalties, fines can only be imposed by a court of law. Cases are referred to court only if a passenger refuses or fails to pay the penalty.
Additionally, fixed penalties have been introduced for certain offences. Unauthorized hawking will attract a fine of ₹2,000, traveling in coaches reserved for women by male passengers will invite a penalty of ₹2,500, and smoking in prohibited areas within trains or railway premises will result in a ₹2,000 fine.
Indian Railways has urged passengers to travel with valid tickets or passes, adhere to railway rules, and cooperate with officials during inspections. The revised provisions aim to promote responsible travel behavior, discipline among passengers, and better protection of railway revenue.
