ರಾಷ್ಟ್ರಗೀತೆ ‘ಜನ ಗಣ ಮನ’ಗೆ ಇರುವ ಕಾನೂನು ರಕ್ಷಣೆಯನ್ನು ರಾಷ್ಟ್ರೀಯ ಗೀತೆ ‘ವಂದೇ ಮಾತರಂ’ಗೂ (Vande Mataram) ವಿಸ್ತರಿಸಲು ಕೇಂದ್ರ ಸರ್ಕಾರ ಮಹತ್ವದ ಹೆಜ್ಜೆ ಇಟ್ಟಿದೆ.
1971ರ ರಾಷ್ಟ್ರೀಯ ಗೌರವಕ್ಕೆ ಅವಮಾನ ತಡೆಯುವ ಕಾಯ್ದೆ (Prevention of Insults to National Honour Act, 1971)ಗೆ ತಿದ್ದುಪಡಿ ತರಲು ಸಿದ್ಧತೆ ನಡೆಯುತ್ತಿದ್ದು, ಕೇಂದ್ರ ಗೃಹ ಸಚಿವ ಅಮಿತ್ ಶಾ ಅವರು ಮುಂಗಾರು ಅಧಿವೇಶನದಲ್ಲಿ ರಾಜ್ಯಸಭೆಯಲ್ಲಿ ‘ವಂದೇ ಮಾತರಂ ಮಸೂದೆ’ ಮಂಡಿಸುವ ಸಾಧ್ಯತೆ ಇದೆ.
ವಂದೇ ಮಾತರಂಗೆ ಸಮಾನ ಕಾನೂನು ರಕ್ಷಣೆ
ಮಸೂದೆ ಅಂಗೀಕಾರವಾದರೆ, ವಂದೇ ಮಾತರಂ ಗೀತೆಗೆ ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿ ಅವಮಾನ ಮಾಡುವುದು ಅಥವಾ ಗಾಯನಕ್ಕೆ ಅಡ್ಡಿಪಡಿಸುವುದು ಶಿಕ್ಷಾರ್ಹ ಅಪರಾಧವಾಗಲಿದೆ. ಇದರಿಂದ ರಾಷ್ಟ್ರಗೀತೆಯಷ್ಟೇ ಸಮಾನ ಕಾನೂನು ರಕ್ಷಣೆ ರಾಷ್ಟ್ರೀಯ ಗೀತೆಗೆ ಲಭ್ಯವಾಗಲಿದೆ.
ಹೊಸ ಮಸೂದೆ ಏನು ಹೇಳುತ್ತದೆ?
ಪ್ರಸ್ತಾಪಿತ ತಿದ್ದುಪಡಿಯ ಪ್ರಕಾರ:
- ವಂದೇ ಮಾತರಂ ಗಾಯನದ ವೇಳೆ ಅಡ್ಡಿಪಡಿಸುವುದು ಅಪರಾಧ
- ಗೀತೆಗೆ ಅವಮಾನ ಮಾಡುವುದು ಕಾನೂನುಬದ್ಧ ಶಿಕ್ಷೆಗೆ ಒಳಪಡುವುದು
- ಗೀತೆಯ ಗೌರವಕ್ಕೆ ಧಕ್ಕೆ ಉಂಟುಮಾಡುವ ಯಾವುದೇ ಕೃತ್ಯ ಅಪರಾಧವಾಗಿ ಪರಿಗಣನೆ
ಪ್ರಸ್ತುತ ಇದೇ ರೀತಿಯ ಕಾನೂನು ರಕ್ಷಣೆ ‘ಜನ ಗಣ ಮನ’ಗೆ ಮಾತ್ರ ಅನ್ವಯವಾಗುತ್ತಿದೆ.
ಅವಮಾನಕ್ಕೆ ಶಿಕ್ಷೆ ಏನು?
ಹೊಸ ಕಾನೂನು ಜಾರಿಯಾದರೆ:
- 3 ವರ್ಷಗಳವರೆಗೆ ಜೈಲು ಶಿಕ್ಷೆ
- ದಂಡ
- ಜೈಲು ಶಿಕ್ಷೆ ಹಾಗೂ ದಂಡ ಎರಡೂ
ಗಾಯನಕ್ಕೆ ಹೊಸ ಮಾರ್ಗಸೂಚಿಗಳು
ಮಸೂದೆಯಲ್ಲಿ ವಂದೇ ಮಾತರಂ ಗಾಯನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಕೆಲವು ನಿಯಮಗಳನ್ನು ಸೂಚಿಸಲಾಗಿದೆ:
- ಎಲ್ಲಾ ಸರ್ಕಾರಿ ಕಾರ್ಯಕ್ರಮಗಳಲ್ಲಿ ವಂದೇ ಮಾತರಂ ಗಾಯನ ಕಡ್ಡಾಯ
- ಕಾರ್ಯಕ್ರಮ ಆರಂಭಕ್ಕೂ ಮೊದಲು ಗಾಯನ ಅಥವಾ ವಾದ್ಯ ಸಂಗೀತ
- ಗೀತೆಯ ಆರು ಚರಣಗಳನ್ನು ಹಾಡಲು ಸೂಚನೆ
- ಸಂಪೂರ್ಣ ಗಾಯನಕ್ಕೆ ಸುಮಾರು 3 ನಿಮಿಷ 10 ಸೆಕೆಂಡುಗಳು
- ಗಾಯನದ ವೇಳೆ ಎಲ್ಲರೂ ಸಾವಧಾನ ಭಂಗಿಯಲ್ಲಿ ನಿಲ್ಲಬೇಕು
- ಶಾಲೆಗಳಲ್ಲಿ ಪ್ರಾರ್ಥನೆಗೂ ಮುನ್ನ ವಂದೇ ಮಾತರಂ ಹಾಡುವುದು/ಪ್ರಸಾರ
ವಂದೇ ಮಾತರಂ ಇತಿಹಾಸ
ವಂದೇ ಮಾತರಂ ಗೀತೆಯನ್ನು ಬಂಕಿಮ್ ಚಂದ್ರ ಚಟ್ಟೋಪಾಧ್ಯಾಯ ರಚಿಸಿದ್ದು, ಸಂಸ್ಕೃತ ಮತ್ತು ಬಂಗಾಳಿ ಭಾಷೆಗಳ ಸಂಯೋಜನೆಯಾಗಿದೆ. 1896ರಲ್ಲಿ ಕೋಲ್ಕತ್ತಾದ ಕಾಂಗ್ರೆಸ್ ಅಧಿವೇಶನದಲ್ಲಿ ಮೊದಲ ಬಾರಿ ಸಾರ್ವಜನಿಕವಾಗಿ ಗಾಯನಗೊಂಡಿತು. ನಂತರ ಸ್ವಾತಂತ್ರ್ಯ ಹೋರಾಟದಲ್ಲಿ ಇದು ದೇಶಭಕ್ತಿಯ ಪ್ರಮುಖ ಸಂಕೇತವಾಗಿ ಹೊರಹೊಮ್ಮಿತು. ಈ ಗೀತೆ ‘ಆನಂದಮಠ’ ಕಾದಂಬರಿಯಲ್ಲೂ ಕಾಣಿಸುತ್ತದೆ.
ಸಂಸತ್ತಿನಲ್ಲಿ ರಾಜಕೀಯ ಚರ್ಚೆ
ಮಸೂದೆ ಇನ್ನೂ ಮಂಡನೆಯಾಗುವ ಮುನ್ನವೇ ರಾಜಕೀಯ ಚರ್ಚೆಗೆ ಕಾರಣವಾಗಿದೆ. ಬಿಜೆಪಿ ಇದನ್ನು ರಾಷ್ಟ್ರೀಯ ಗೌರವವನ್ನು ಬಲಪಡಿಸುವ ಕ್ರಮ ಎಂದು ಸಮರ್ಥಿಸುತ್ತಿದ್ದರೆ, ಕಾಂಗ್ರೆಸ್ ಸೇರಿದಂತೆ ವಿರೋಧ ಪಕ್ಷಗಳು ಟೀಕಿಸಿವೆ. ಕಾನೂನುಗಳ ಮೂಲಕ ದೇಶಭಕ್ತಿಯನ್ನು ಬಲವಂತವಾಗಿ ಜಾರಿಗೊಳಿಸುವ ಪ್ರಯತ್ನ ಎಂದು ವಿಪಕ್ಷಗಳು ಆರೋಪಿಸಿವೆ.
ಮುಂಗಾರು ಅಧಿವೇಶನದಲ್ಲಿ ಗದ್ದಲ
ಮುಂಗಾರು ಅಧಿವೇಶನದ ಮೊದಲ ದಿನವೇ ನೀಟ್ ಪ್ರಶ್ನೆಪತ್ರಿಕೆ ಸೋರಿಕೆ, ಪರೀಕ್ಷಾ ಅಕ್ರಮಗಳು, ವಿದ್ಯಾರ್ಥಿಗಳ ಪ್ರತಿಭಟನೆ ಹಾಗೂ ರಾಮಮಂದಿರ ಕಾಣಿಕೆ ದುರುಪಯೋಗ ಆರೋಪ ಸೇರಿದಂತೆ ಹಲವು ವಿಚಾರಗಳನ್ನು ಮುಂದಿಟ್ಟುಕೊಂಡು ಲೋಕಸಭೆ ಮತ್ತು ರಾಜ್ಯಸಭೆಯಲ್ಲಿ ವಿಪಕ್ಷಗಳು ತೀವ್ರ ಪ್ರತಿಭಟನೆ ನಡೆಸಿದವು. ಗದ್ದಲದ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಕಲಾಪವನ್ನು ಪದೇಪದೇ ಮುಂದೂಡಲಾಯಿತು.
ಎರಡನೇ ದಿನವೂ ಸರ್ಕಾರವನ್ನು ತರಾಟೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲು ವಿಪಕ್ಷಗಳು ತಂತ್ರ ರೂಪಿಸುತ್ತಿದ್ದು, ರಾಜ್ಯಸಭೆಯ ವಿರೋಧ ಪಕ್ಷದ ನಾಯಕ ಮಲ್ಲಿಕಾರ್ಜುನ ಖರ್ಗೆ ನೇತೃತ್ವದಲ್ಲಿ ಪ್ರಮುಖ ನಾಯಕರ ಸಭೆ ನಡೆಯಲಿದೆ.

Centre Moves to Grant Legal Protection to ‘Vande Mataram’
New Delhi: The Central government has taken a significant step to extend the same legal protection granted to the National Anthem ‘Jana Gana Mana’ to the National Song ‘Vande Mataram’. The government is preparing to amend the Prevention of Insults to National Honour Act, 1971, and Union Home Minister Amit Shah is likely to introduce the proposed Vande Mataram Bill in the Rajya Sabha during the Monsoon Session.
Equal Legal Protection for Vande Mataram
If passed, the bill will make any intentional insult to Vande Mataram or disruption of its rendition a punishable offence. This would place the National Song on par with the National Anthem in terms of legal protection.
What the Proposed Amendment Says
According to the proposed changes:
- Interrupting the singing of Vande Mataram will be considered an offence
- Insulting the song will attract legal action
- Any act undermining its dignity will be punishable
At present, such legal protection applies only to Jana Gana Mana.
Penalties for Insult
If the law comes into force, offenders may face:
- Imprisonment of up to three years
- A fine
- Or both imprisonment and fine

New Guidelines for Rendition
The bill also proposes guidelines for the singing of Vande Mataram:
- Mandatory rendition at all government functions
- Singing or instrumental performance before official events begin
- Recommendation to sing all six stanzas
- Full rendition duration: approximately 3 minutes and 10 seconds
- Attendees must stand in attention during the performance
- Schools to include it in morning prayers or broadcast it
Historical Background
Vande Mataram was composed by Bankim Chandra Chattopadhyay in a mix of Sanskrit and Bengali. It was first sung publicly at the 1896 session of the Indian National Congress in Kolkata. The song later became a powerful symbol of patriotism during India’s freedom struggle and also appears in his novel Anandamath.
Political Reactions
Even before its introduction in Parliament, the bill has sparked political debate. While the BJP has defended it as a move to strengthen national pride, opposition parties, including the Congress, have criticised it, alleging that it attempts to enforce patriotism through law.
Uproar in Parliament
On the first day of the Monsoon Session, both the Lok Sabha and Rajya Sabha witnessed disruptions as opposition parties raised issues such as the NEET paper leak, exam irregularities, student protests, and allegations related to misuse of Ram Temple donations. Proceedings in both Houses were adjourned multiple times amid the uproar.
The opposition is expected to continue its protest strategy on the second day, with a meeting of key leaders scheduled under the leadership of Rajya Sabha Opposition Leader Mallikarjun Kharge.
